Terms of Use for Houma

By using Houma (the “Houmadz.com” or the Houma mobile app), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, you must not use Houma. These Terms govern your use of Houma, a real-estate listing service operating in Algeria, and form a legally binding agreement between you (“User”) and Houma.

Scope of Service

• Nature of the Platform: Houma is an online real-estate platform in Algeria. Houma enables users to browse, search, and post listings of real property located in Algeria, including residential and commercial properties, rentals and sales, new developments, and undeveloped land (plots) – in short, all types of real-estate listings.
• User Types: Houma’s users may include individual buyers, renters, property sellers, landlords, tenants, licensed real estate agents and brokers, developers, builders, property managers, and other businesses involved in real estate. All Users must comply with these Terms.
• User Listings: Users may post property listings for sale or rent. Each listing must be accurate, lawful, and relate to real properties in Algeria. You represent and warrant that you have the right to list the property (for example, you are the owner or have the owner’s permission) and that all information you provide (price, description, photos, etc.) is true and correct. Houma is not a party to any transaction; we simply provide the platform for listings.

User Registration and Eligibility

• User Accounts: To access certain features (such as posting listings or saving searches), you may need to register for a free Houma account. You agree to provide truthful and accurate registration information (name, email, phone, etc.) and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• Age Requirement: Users must be at least 18 years old (or the age of legal majority in Algeria) to use Houma. By registering or using Houma, you confirm that you meet this age requirement.
• Multiple Listings: Each User account is for a single natural person or entity. You must not share your account or password with others. Houma may disable accounts that appear to be shared or used in violation of these Terms.

Acceptable Use and Prohibited Conduct

Users must use Houma lawfully and in good faith. Prohibited activities include (without limitation):

• Illegal or Harmful Use: You must not use Houma to post or transmit any content that is unlawful, fraudulent, libelous, defamatory, obscene, offensive, invasive of privacy or publicity rights, infringing of intellectual property rights, or otherwise objectionable or harmful. This includes content that is obscene, hateful, violent, infringing on third parties’ rights, or encouraging illegal activities.
• No Automated Access: You must not use robots, spiders, crawlers, scrapers, or similar automated technologies to access or use the Site in a manner that we have not expressly authorized. Unauthorized scraping or systematic data collection is prohibited.
• No Hacking or Disruption: You must not attempt to probe, scan, or test the vulnerability of the Site, breach security or authentication measures, or disrupt the Site’s operation (e.g. by introducing viruses or malware).
• No Spam or Unsolicited Contact: You agree not to send spam, chain letters, or any unsolicited communications through Houma. You must not harass other Users or use Houma to solicit others for commercial purposes without express permission.
• No User-Generated Content (Reviews/Comments): Houma does not permit third-party reviews, comments, messages, or other user-generated content (aside from property listing information you provide about your own property). In particular, Users may not post opinions, reviews of listings, or discussion comments on Houma. Any attempt to post such content will be removed.
• Compliance with Laws: You agree to comply with all applicable Algerian laws, regulations, and local ordinances in your use of Houma and in any transaction conducted via Houma. This includes Algeria’s real-estate and consumer-protection laws.

If Houma determines, at its sole discretion, that you have violated these rules, we may suspend or terminate your access and remove any content you have posted. Houma reserves the right to take down any listing or content at any time, with or without notice, in our discretion.

Property Listings and Content Guidelines

When creating a property listing on Houma:

• Accurate Information: You must provide complete and accurate information about the property (price, location, size, features, condition, etc.). Do not mislead or misrepresent material details. Houma is not responsible for verifying the accuracy of listings; listing accuracy is your responsibility.
• Appropriate Content: Photos and descriptions must pertain solely to the listed property. Do not include irrelevant images or information (for example, advertising material for other products or text unrelated to the property).
• Legal Compliance: You must own or have express authorization to list the property. Listings for illegal or unregistered developments, or properties that the lister is not authorized to sell/rent, are prohibited.
• No Prohibited Items: Listings must not involve sale or lease of illegal properties or activities, or products that are illegal under Algerian law (for example, firearms).

Houma may remove or modify any listing that violates these guidelines. If you repeatedly post prohibited content, Houma may suspend or terminate your account.

Paid Services and Premium Listings

Houma may offer certain paid features (such as featured listings, advertising packages, or subscription services) to enhance visibility or functionality.

• Payment Terms: Any purchase of a paid service is subject to the terms of the specific offer (including pricing, duration, and renewal terms). If you subscribe or pay for a listing upgrade, you authorize Houma (or our payment processor) to charge your chosen payment method. No refunds will be given except as required by law. Feature credits (if any) may expire if not used as specified, and unused credits generally will not be refunded.
• Use of Paid Features: Premium listings or advertising products will be applied only to active, approved property listings. Houma reserves the right to refuse, remove, or reclassify paid placements if the associated listing is in draft or violates any conditions. For example, if a listing is removed, deleted, or no longer meets conditions for a paid feature, Houma may revoke the premium status without refund.
• Changes to Paid Services: Houma may change or discontinue paid services at any time. Existing paid subscriptions will be governed by the terms active at the time of purchase, subject to these Terms.

Intellectual Property

• Site Content: Houma and its licensors own all intellectual property rights (copyrights, trademarks, databases, etc.) in the Site and its content (including the design, graphics, text, software, and data). Houma’s trademarks and logos are protected; you may not use them without permission.
• User Content License: By posting a property listing (including photos and text) on Houma, you grant Houma a royalty-free, worldwide, non-exclusive, transferable license to use, reproduce, modify, and display that content on the Site and in promotional materials (consistent with our Privacy Policy). You remain the owner of your content, but you give us permission to use it to operate the Service.
• Restrictions on Use: You may not copy, modify, publish, transmit, distribute, or create derivative works of the Site’s content except as expressly allowed by Houma. For example, you may not frame or mirror the Houma Site, or extract bulk data or images for reuse off-site, without permission.

Privacy and Communications

Your privacy is important. Houma’s collection and use of personal data is described in ourPrivacy Policy, which you should read. By using Houma, you consent to the collection and processing of your data as described therein.

• Communications: You agree that Houma may send you service-related emails (for example, confirmation messages, notices about listings, newsletters if subscribed, or changes to Terms) without additional consent. If you wish to unsubscribe from promotional communications, you may use the unsubscribe link in those emails.

Disclaimers and Limitation of Liability

Houma provides the Service “as is” and does not guarantee that Houma will be error-free or uninterrupted. We make reasonable efforts to keep the site accurate, but we do not warrant the accuracy, reliability, or completeness of any listing or other content on Houma. You use Houma and any information on it at your own risk. For example, we do not verify that property details are correct; if you rely on them, you do so at your own risk.

• No Liability for Third Parties: Houma is not a party to any property transaction. We disclaim all liability for dealings between buyers and sellers or other Users. Houma does not warrant any action taken by Users, nor the quality or legality of properties listed.
• Limitation of Liability: To the fullest extent permitted by Algerian law, Houma (and its affiliates, officers, and employees) will not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of your use of Houma. Our total liability for direct damages is limited to the amount you paid (if anything) for the Houma services at issue. This limitation applies even if we have been advised of the possibility of such damages.
• Indemnification: You agree to indemnify and hold harmless Houma (and its owners, officers, employees, and agents) from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of Houma, your breach of these Terms, or any violation of law by you. This includes any claims brought by third parties based on content you post or actions you take in connection with Houma.

Modifications and Termination

• Changes to Terms: Houma may modify these Terms at any time by posting the revised Terms on the Site. Your continued use of Houma after any changes means you accept the new Terms. We recommend that you check this page periodically for updates.
• Changes to Site: Houma may update, improve, or discontinue parts of the Service at any time, with or without notice. Houma will not be liable if, for any reason, all or any part of the Site is unavailable.
• Termination: Houma reserves the right, in its sole discretion, to suspend or terminate your access to Houma (or any portion of it) with or without notice, for any reason (including violation of these Terms). Upon termination, your right to use the Service will immediately cease.

Governing Law and Dispute Resolution

These Terms and your use of Houma are governed by the laws of Algeria. Any dispute arising out of or relating to these Terms or the Houma service shall be subject to the exclusive jurisdiction of the courts of Algeria. You agree to abide by Algerian real-estate and consumer-protection regulations in any transaction or dispute related to Houma.

General Provisions

• Entire Agreement: These Terms (together with any other documents they incorporate by reference, such as our Privacy Policy) constitute the entire agreement between you and Houma regarding the Service.
• Severability: If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remainder of these Terms will remain in full force.
• No Waiver: Houma’s failure to enforce any right under these Terms does not constitute a waiver of that right.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without Houma’s prior written consent. Houma may freely assign its rights and obligations.
